Website Development Agreement & Terms

Agreement Between Customer and Techy Chicks Digital

These Website Development Agreement and Terms & Conditions ("Agreement") apply to website development and related services provided by Techy Chicks Digital ("Techy Chicks," "we," "us," or "our") to the person or business purchasing the services ("Customer," "you," or "your").

By completing an order, electronically accepting this Agreement and submitting payment, you acknowledge that you have reviewed and agree to these terms.

Your completed online order, including the website options and add-on services you select, becomes part of this Agreement.

Website Development Services

Techy Chicks Digital will provide the website development services selected in your completed order.

The standard website package includes:

• Professional website development
• Up to five website pages
• Up to five products
• Responsive/mobile-friendly website design
• Logo and image integration using Customer-provided materials
• Regular SEO Foundation
• First year of Techy Chicks Digital website hosting
• First-year registration of one available standard domain, when applicable
• Reasonable revisions before final approval

Features, integrations, custom programming, additional pages, additional products or services not expressly included in the Customer's order may require additional charges or a separate agreement.

Pricing, Add-Ons & Payment

The Customer agrees to pay the price displayed and confirmed during checkout for the services selected.

Optional hosting and domain coverage periods may also be selected during checkout. The amount shown in the Customer's final order summary controls the amount due for the services selected, subject to correction of an obvious pricing or technical error.

Payment must be successfully completed before website development begins unless Techy Chicks Digital expressly agrees otherwise in writing.

Same-Day Website Service

Techy Chicks Digital offers expedited same-day website service for qualifying website projects submitted on business days.

Required materials may include, as applicable, business information, website content, logo files, images, product information, product images, contact information, design preferences and any other information reasonably necessary for Techy Chicks Digital to begin and complete the website project.

The same-day service period does not begin when the Customer first starts the order form. The Customer's order must be complete, payment must be successfully received, and all required materials must be received by Techy Chicks Digital before the applicable cutoff.

If the Customer submits payment before the cutoff but does not provide all required materials until after 12:00 PM CT, the project will not qualify for that business day's same-day service.

For purposes of same-day website service, business days are Monday through Friday, excluding federal holidays and other closure dates announced by Techy Chicks Digital.

Orders completed on Saturdays, Sundays, federal holidays, or other announced closure dates will ordinarily enter the development queue for the next business day.

Same-day service applies to qualifying projects that remain within the scope of the website package and services purchased by the Customer.

Additional or custom development, incomplete or inaccurate information, missing materials, changes to the project scope, additional Customer requests, delays in Customer responses, technical problems involving third-party services, unusually complex project requirements, or circumstances outside Techy Chicks Digital's reasonable control may require additional development time.

Requests that materially exceed the scope of the Customer's purchased website package may require additional fees and development time.

Customer Responsibilities

The Customer is responsible for providing accurate and complete information reasonably necessary to develop the website.

This may include:

• Business name and contact information
• Business description and services
• Logo and branding materials
• Website images
• Product names, prices, descriptions and images
• Social media links
• Desired website pages
• Domain information
• Website wording or information needed for copywriting
• Other information reasonably necessary for the selected services

The Customer is responsible for reviewing submitted information for accuracy. Techy Chicks Digital is not responsible for errors caused by inaccurate, incomplete or outdated information supplied by the Customer.

Customer Content & Intellectual Property

The Customer represents that the Customer owns, has permission to use, or otherwise has sufficient rights to provide all logos, photographs, videos, text, trademarks, product information and other materials submitted to Techy Chicks Digital for use on the website.

The Customer authorizes Techy Chicks Digital to use, reproduce, resize, format, optimize and otherwise process Customer-provided materials as reasonably necessary to perform the purchased services.

The Customer remains responsible for the legality and accuracy of the Customer's business claims, product claims, pricing, policies, advertising statements and other Customer-provided content.

Ownership, licensing or transfer of third-party software, platform accounts, stock materials, plugins, fonts, themes, domains or other third-party assets remains subject to the terms of the applicable provider.

Revisions & Final Approval

The standard website package includes reasonable revisions before final approval so that the Customer can identify reasonable corrections or concerns with the completed website.

A revision is not a request to replace the agreed project with a materially different website or to add substantial features, pages, products or functionality that were not included in the original order.

Requests that materially expand the original scope may require an additional fee.

When the Customer communicates final approval of the website, the initial website development project is considered completed.

Cancellation & Refund Policy

Because website development involves customized professional services and work performed specifically for the Customer, website development fees are non-refundable once Techy Chicks Digital has started work on the Customer's project, except where otherwise required by applicable law.

Before work begins, any cancellation or refund request will be reviewed based on the status of the order, payment processing costs, third-party purchases already made for the Customer and any other applicable commitments.

Domain registrations, premium domains, third-party licenses, software, hosting commitments or other non-refundable third-party costs purchased for the Customer may not be refundable once purchased.

Website Hosting & Domain Coverage

The standard website package includes the first year of Techy Chicks Digital website hosting and, when applicable, registration of one available standard domain for the first year.

Premium domains, aftermarket domains, specialty domain extensions and domains with registration or renewal costs exceeding the standard allowance are not included and may require an additional fee.

Any multi-year option selected by the Customer represents the total coverage period, including the first year already included with the website package.

Continued hosting and domain service after the included or prepaid term requires timely renewal and payment.

Failure to timely renew hosting or a domain may result in website interruption, domain expiration, loss of service or third-party recovery charges.

Domain availability is not guaranteed until registration is successfully completed.

SEO Services & Search Engine Results

Every Techy Chicks Digital website includes our Regular SEO Foundation.

Depending on the website, this may include SEO-friendly page titles and meta descriptions, heading structure, image ALT text, search-friendly page structure, mobile optimization, internal linking, canonical URLs, schema markup where appropriate, sitemap preparation and other technical on-page SEO fundamentals.

Customers may purchase the Complete SEO Upgrade for $249. This is a one-time enhanced SEO service for up to five website pages and may include keyword research, keyword targeting, local or geographic optimization when applicable, enhanced page titles and descriptions, keyword-focused headings and content optimization, enhanced internal linking, image optimization and enhanced schema markup where appropriate.

Search-engine algorithms, rankings, indexing and visibility are controlled by third parties and may change over time.

Third-Party Platforms & Services

A website may rely on third-party services, including domain registrars, hosting providers, payment processors, email providers, social networks, plugins, APIs, analytics tools, e-commerce services or other technology providers.

Techy Chicks Digital does not control third-party companies and cannot guarantee that any third-party service will remain available, unchanged or error-free.

The Customer may be required to accept separate terms, create accounts or pay fees directly to third-party providers for services outside the Techy Chicks Digital package.

Updates After Final Approval

After final approval, new website work is not included in the original development fee unless expressly stated otherwise.

The price of an informational update may vary depending on the scope and complexity of the requested work. Larger changes, redesigns, custom functionality or additional services may require separate pricing.

Service Limitations

Techy Chicks Digital will use reasonable professional efforts to provide the services purchased by the Customer.

However, no website can be guaranteed to operate without every possible interruption or error under all circumstances, particularly where third-party platforms, internet services, browsers, devices, hosting providers or external integrations are involved.

Techy Chicks Digital does not guarantee specific business revenue, sales, website traffic, customer conversions, search rankings or other business outcomes resulting from a website.

To the extent permitted by applicable law, Techy Chicks Digital will not be responsible for indirect, incidental, special or consequential damages arising from circumstances outside the scope of the purchased services or from third-party services.

Claims Relating to Customer-Provided Materials

The Customer is responsible for Customer-provided content and for having the necessary rights to use that content.

To the extent permitted by applicable law, the Customer agrees to be responsible for claims arising from materials, representations or instructions supplied by the Customer that infringe another person's intellectual-property or other legal rights, or that violate applicable law.

Governing Law & Entire Agreement

This Agreement is governed by applicable law, including the laws of the State of Texas where applicable, without regard to conflict-of-law principles.

The Customer's completed order, this Agreement, and any written project-specific terms accepted by Techy Chicks Digital constitute the agreement concerning the purchased services and supersede prior discussions concerning those services.

If a provision of this Agreement is determined to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Electronic Communications, Signature & Acceptance

The Customer agrees that electronic communications may be used in connection with the website project, including order confirmations, project communications, approvals, agreements and other notices.

By checking the required agreement box during checkout, entering the Customer's electronic signature or typed name where requested, and submitting the order, the Customer indicates the Customer's intent to electronically accept this Agreement.

The Customer should save or print a copy of this Agreement for their records.
